Purchase and booking terms – physical events and leisure courses

Nawa Studio is operated by Creatio Haerent Studio AB, company registration number 559594-6632, hereinafter “Nawa Studio”.

1. Scope of the terms

These terms apply when booking and purchasing a place or ticket for physical events, workshops and leisure courses arranged by Nawa Studio on a specified day and time.

The terms apply to both private individuals and companies. The provisions that specifically concern consumers apply only to natural persons who book mainly for purposes outside a business activity.

The terms do not cover digital courses, webinars, memberships, venue hire, individually commissioned services or resale of tickets. Such services may be covered by other terms.

By completing the booking, the customer accepts these terms.

2. Binding booking and agreement

A booking is binding when the customer has completed the booking, any direct payment has been approved, and Nawa Studio has sent a booking confirmation to the email address provided by the customer.

For bookings against invoice, the booking becomes binding when Nawa Studio sends the booking confirmation.

The booking confirmation must contain information about the main content of the event or course, date, time, physical location and price.

The customer is responsible for ensuring that the details provided are correct and must contact Nawa Studio as soon as possible if the booking confirmation contains errors.

The number of places may be limited. A place is not reserved or guaranteed until the booking has been confirmed as described above.

3. Price and payment

Prices are stated in Swedish kronor (SEK). Prices to consumers are stated including VAT.

Payment must be made using the payment method and by the due date stated at booking or on the invoice.

Nawa Studio may change prices for future bookings. An already confirmed booking is not affected by later price changes.

In the event of late payment, default interest and statutory fees may be added.

4. Right of withdrawal

A consumer normally has a 14-day right of withdrawal for distance contracts.

Bookings covered by these terms concern, however, cultural events or other similar leisure activities carried out on a specified day or during a specified period. Under Chapter 2, Section 11(12) of the Swedish Distance and Off-Premises Contracts Act (2005:59), no statutory right of withdrawal therefore normally applies.

The customer therefore cannot withdraw from the booking by relying on the ordinary 14-day withdrawal period.

If a particular booking is not covered by the statutory exemption, the consumer's rights under mandatory law apply.

5. Customer cancellation and non-attendance

The booking is binding. Nawa Studio offers no refund if the customer cancels, is ill, changes plans, has travel problems, arrives late or does not attend.

This applies regardless of how far in advance of the event or course the cancellation is made.

A cancellation does not release the customer from the obligation to pay. Amounts already paid are not refunded and unpaid amounts must be paid in accordance with the agreement.

The customer can give notice of non-attendance through the booking system or by contacting support@nawastudio.se. Such notice does not change the obligation to pay.

The customer has no right to rebooking, gift cards or credit. If Nawa Studio offers such a solution in an individual case, it is voluntary and does not mean that the customer is entitled to the same solution for future bookings.

Nothing in this section limits the rights a consumer has under mandatory law. The provision does not, however, give the customer a right to a refund in the event of their own cancellation, illness or non-attendance.

6. Changes or cancelled events

Nawa Studio may cancel an event or course occasion, for example because of too few participants, illness of an essential contributor or other circumstances that mean the event cannot reasonably be held.

If the event is cancelled, the customer may choose to:

  • accept a place at a new occasion, if one is offered, or
  • receive a refund of the amount paid to Nawa Studio for the booking.

The customer is not obliged to accept a new date.

If the event is moved to another day or time, the customer may choose between keeping the booking for the new occasion or receiving a refund of the booking amount.

Nawa Studio may make minor changes to content, internal schedule, contributors or venue, provided that the main character of the event is unchanged and the change does not cause significant disadvantage to the customer. Such minor changes do not normally give a right to a refund.

If a central part of the event is removed, or the event otherwise deviates materially from what was promised, the customer may be entitled to a price reduction or a refund depending on the significance of the change.

Nawa Studio is not liable for the customer's indirect costs, such as travel, accommodation, childcare or lost income, to the extent not otherwise required by mandatory law.

7. Circumstances beyond Nawa Studio's control

Nawa Studio is not liable for delays or other obstacles caused by circumstances beyond its reasonable control, such as decisions by authorities, war, fire, natural events, epidemics or pandemics, industrial action, extensive operational disruption or serious illness of an essential contributor.

Nawa Studio must inform the customer as soon as possible.

If the event is cancelled or moved because of such a circumstance, the customer's options under section 6 apply. Force majeure therefore does not mean that the customer must accept a new date.

8. Complaints

If the event deviates materially from the booking information or the booking confirmation, the customer can complain by contacting support@nawastudio.se. A complaint should be made within a reasonable time after the customer discovered the fault.

In the case of a justified complaint, the customer's rights under applicable law apply. The right to complain does not give any right to a refund in the event of the customer's own cancellation, illness or non-attendance.

9. House rules and liability

The customer and other participants covered by the booking must follow Nawa Studio's safety and house rules and the instructions of the staff.

Nawa Studio may refuse entry or remove a participant who behaves disruptively or threateningly, is noticeably intoxicated or jeopardises safety. No refund is given in such cases.

The customer is liable for damage that the customer or a participant in the customer's booking causes intentionally or through negligence to the venue, the equipment or other property.

10. Personal data

Creatio Haerent Studio AB is the data controller for the processing of the personal data provided when booking.

The data is processed to administer the booking, handle payment, communicate information about the event and fulfil legal obligations such as accounting requirements.

Newsletters and other direct marketing are handled separately and are only sent where there is a valid legal basis. The customer can object to direct marketing at any time.

11. Changes to the terms

Nawa Studio may change these terms for future bookings.

Changes do not affect bookings that are already confirmed. An existing booking is governed by the version of the terms the customer accepted at the time of booking.

Swedish law applies to the booking.

If the customer is a consumer and a dispute cannot be resolved directly with Nawa Studio, the customer can request a review by the Swedish National Board for Consumer Disputes, www.arn.se. A dispute may also be decided by a Swedish general court.
